These Terms & Conditions (“Terms”) govern your use of the website and services of Pretty Sweets, a business operating in the State of Alaska. By accessing our website or placing an order, you agree to these Terms.

Custom Cake Designs

We strive to match requested designs; however, slight variations in color, size, decor, or detail may occur.
Reference photos are for inspiration.
Final design interpretation remains at our artistic discretion.
Customers are responsible for verifying spelling, dates, and details at the time of order confirmation.

3. Food Safety & Allergens

Our kitchen may handle common allergens including milk, eggs, wheat, soy, peanuts, and tree nuts.

While we follow safe food handling practices consistent with Alaska state food safety regulations, we cannot guarantee that any product is completely allergen-free due to possible cross-contact.

Customers with severe allergies assume full responsibility when placing an order.

4. Alaska Cottage Food Disclosure (If Applicable)

If operating under Alaska’s Cottage Food laws:

Products are homemade and not subject to state inspection.

5. Cancellations & Refund Policy

Deposits for custom orders are non-refundable.
Cancellations made more than 4 days before the event may qualify for partial refund of payments made beyond the deposit.
Cancellations made within 2 days of the event date are non-refundable.
No refunds will be issued once a cake has been picked up or delivered and accepted.
Refunds are not provided for dissatisfaction due to design preference once the agreed design has been fulfilled.

6. Pickup, Delivery & Risk of Loss

Customers are responsible for inspecting the product at pickup.
Once the cake leaves our possession, the customer assumes all responsibility for damage, storage, and handling.
For deliveries, responsibility transfers upon successful delivery to the provided address.
We are not liable for damage caused by improper storage, transportation, weather exposure, or third parties.

7. Storage & Care

Cakes must be stored according to provided instructions.
Most cakes require refrigeration until 1–2 hours before serving.
Failure to follow care instructions voids any quality-related concerns.

8. Limitation of Liability

To the fullest extent permitted by Alaska law:

Our total liability shall not exceed the amount paid for the product.
We are not liable for indirect, incidental, consequential, or special damages arising from use of our website or products.

9. Website Use & Intellectual Property

All website content, including text, images, logos, branding, and designs, are the intellectual property of Pretty Sweets and may not be copied or reproduced without written consent.

We reserve the right to use images of our products for marketing and promotional purposes.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alaska. Any disputes shall be resolved in the appropriate state or federal courts located in Alaska.

11. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our website or services after changes are posted constitutes acceptance of those changes.

Return and Refund Policy

This Return & Refund Policy applies to all purchases from Pretty Sweets , a home-based cottage food operation business certified in the State of Alaska.

1. Cottage Food Disclosure

Our products are homemade and not subject to state inspection.

All items are prepared in a home kitchen that may process common food allergens.

2. Perishable Food Policy (No Returns)

Due to the perishable nature of baked goods and for food safety reasons:

We do not accept returns of any cakes or edible products.
All sales are considered final once the product has been picked up or delivered.

3. Deposits & Cancellations

All custom cake deposits are non-refundable.
Cancellations made more than 4 days before the event date may receive a partial refund of payments made beyond the deposit.
Cancellations within 2 days of the event date are non-refundable.

Because products are made-to-order, we begin purchasing supplies and reserving time immediately after booking.

4. Refund Consideration

Refunds may only be considered if:

The wrong product was provided, or
The product was damaged prior to pickup or during delivery by us.

If there is a concern:

You must notify us within 24 hours of pickup or delivery.
Provide clear photographs.
Retain the product for possible review.

We reserve the right to deny refunds if:

The product has been consumed in excess of a reasonable tasting portion.
The cake was mishandled, improperly stored, or altered after pickup.
The design matches the agreed-upon order but does not meet personal taste preference.

5. Allergies & Ingredient Responsibility

Our home kitchen may contain or come into contact with:

Milk
Eggs
Wheat
Soy
Peanuts
Tree nuts

Butter

We cannot guarantee an allergen-free environment.

Customers assume full responsibility for allergy-related risks when placing an order.

Refunds will not be issued for allergic reactions when proper ingredient disclosure was provided.

6. Pickup Responsibility

Once the cake leaves our possession, the customer assumes all responsibility for:

Safe transport
Proper storage
Protection from weather or damage

We are not responsible for damage occurring after pickup.

7. Refund Processing

If a refund is approved, it will be issued to the original payment method within 1-3 business days.
